Johnson & Bell Shareholder, Gregory E. Schiller, and Attorney, Caroline K. Vickrey, secured a defense verdict in favor of their hospital client in a Cook County trial seeking $9 million in damages. In this medical malpractice case, a 17-year-old-girl presented to the defendant hospital emergency room with leg pain. The hospital provider ordered an ultrasound to rule out deep vein thrombosis (DVT), which the radiologist interpreted as normal with no DVT. The patient was discharged the same day. Two days later, the patient was found unresponsive at home, and subsequently died. The plaintiff’s decedent filed a lawsuit against Johnson & Bell’s hospital client as well as the radiologist and her corporation, alleging that the radiologist should have read the ultrasound as abnormal. The defendants argued that the ultrasound was normal and the decedent died of an unrelated heart condition which was not previously diagnosed. At closing, the plaintiff’s attorney asked the jury for $9 million in damages. The jury deliberated for 90 minutes before delivering a verdict in favor of Johnson & Bell’s client and all other defendants.
