J&B Chicago Associate Secures Significant Medical Malpractice Win

Associate Dane Spencer represented an Illinois medical center and a hematologist/oncologist in a medical malpractice case alleging misdiagnosis of blood cancer and resulting injury, including claims surrounding the plaintiff’s treatment in the context of prenatal considerations. Pursuant to 735 ILCS 5/2-622, Dane sought dismissal of the action based on the legal insufficiency of the plaintiff’s health professional report. The motion identified multiple statutory deficiencies, including the omission of the reviewing clinician’s profession. Dane also established that the report failed to provide the court with a sufficient basis to support an alleged deviation from the applicable standard of care in oncology. After briefing and oral argument, the court entered an order dismissing the action with prejudice in favor of our clients. The ruling resolved the litigation against both defendants, bringing an end to a years-long dispute concerning the treatment and the medical center’s alleged liability.
