Johnson & Bell Shareholders, Gregory E. Schiller and Caroline K. Vickrey, obtained a defense verdict in favor of their hospital client in a medical malpractice dispute in Cook County. In this case, plaintiff filed suit based on complications following a da Vinci® robotic-assisted hysterectomy. Plaintiff claimed institutional negligence and apparent agency against the hospital in regards to a surgeon who was represented by separate counsel. The Judge directed a verdict in favor of the hospital on the institutional negligence claim following defense arguments that plaintiff had not established causation as to that cause of action. The case went to the jury on the agency issue and the underlying medical negligence case based on allegations that the surgeon did not employ appropriate surgical techniques causing permanent kidney damage. Plaintiff asked for $2.4M. The jury returned a verdict for all defendants after three hours of deliberation.
