Johnson & Bell Shareholders, Lynn M. Reid and David M. Macksey, were successful on an appeal to the Appellate Court in an assisted living case that involved an arbitration agreement. The trial court granted the defendant’s motion to transfer a portion of the case to arbitration but declined to issue a stay of the remaining portion of the case, pending arbitration. The appellate court reversed and found that the trial court must stay the remaining portion of the case, while the portion subject to arbitration proceeds. The arbitration agreement was upheld.
