Just a quick note that Johnson & Bell’s Insurance Coverage Team is monitoring new filings of insurance coverage disputes related to the COVID-19 pandemic. In these coverage disputes, we also are assessing the various arguments for and against coverage for Business Income Loss and Civil Authority provisions. Granted, these early filings are only the proverbial “tip of the iceberg” and the issues being argued are case specific and the policy provisions vary depending on the carrier and the type of coverage issued. Some have specific exclusions for Virus and Bacteria. Some do not. Business Income coverage requires direct physical damage to the insured premises. Many policies are only for specific "Covered Causes of Loss" which typically include wind, fire, explosion, riot etc. Some are "All Risk" which means that any direct physical damage is covered unless otherwise excluded.
