In a complex product liability case in Federal Court in Michigan, we represented a
manufacturer of a paper-making machine, sued when plaintiff sustained a partial
amputation of his dominant hand while reaching into the machine to attempt to clear
a jam. In a case of first impression in the Michigan state and federal courts, we argued
that application of the Michigan Statute of Repose for Improvements to Real Property
applied to bar plaintiff’s claim. Aggressive discovery secured admissions from the
machine owner and others that allowed us to successfully argue that the machine was
indeed an improvement to real property, resulting in judgment in favor of our client and
a published opinion that is regularly cited as precedent by defendants in product liability
cases in Michigan and elsewhere.
