Together, the panel will discuss, “The Import of a Reservation of Rights Letter.” Their discussion will cover issues related to when an insured has made a claim and there are possible defenses to providing insurance coverage. The reservation of rights letter is an important tool to preserve such defenses. Differences in approaches and contents can vary widely, but no matter how much experience a person has drafting reservation of rights letters, it is still easy to omit something. This panel will discuss the content, procedure, timing and effect of the issuance of reservation of rights letter as well as a possible forfeiture of the carrier’s defenses if not drafted carefully.
