No CA-85-38, aff’d, 884 F.2d 779 (4th Cir. 1989); on remand and cross-motions for fees, plaintiff attorney sanctioned and fees awarded, 134 F.R.D. 128 (W.D.N.C. 1991), aff’d, 966 F.2d 1443 (4th Cir. 1992).
