Breitweiser-Hurst Secures SJ for Officers, Municipality in False Arrest, Defamation Dispute

Catherine Breitweiser-Hurst obtained summary judgment in favor of her clients in a municipal liability dispute.  In this case, plaintiff filed a lawsuit against three police officers, their police department and the municipality related to two separate incidents and claiming official misconduct, defamation, false arrest and seeking punitive damages.  Ms. Breitweiser-Hurst filed a motion for summary judgment with respect to the plaintiff's claims and causes for the incident occurring on April 2, 2020.  The Lake County Court granted in favor of the defendants for all claims and causes related to the April 2, 2020 incident.  The court also granted summary judgment in favor of defendants for many of the claims and causes associated with the second incident, including demands for punitive damages, occurring on April 28, 2020.  The plaintiff's case related to the second incident will move forward with only a few issues remaining to be addressed.
