The issue of age discrimination class action lawsuits will be the topic when Johnson & Bell Shareholder, Joseph F. Spitzzeri, serves as a featured panelist at the AFLA International 2019 Labor and Employment Conference. Mr. Spitzzeri’s panel will discuss the issue, “What in Tarnation? Is that Facebook Recruitment Ad Discriminatory? Employers Facing Age Discrimination Class Actions.” The panel will address issues raised by the plaintiff’s firm, Outten & Golden, who sued a proposed defendant class of every employer who posted recruiting ads on Facebook using age targeting limitations. This ongoing age discrimination class action litigation raises fascinating and complex procedural and merits issues. In addition, the proposed defendant class is so vast that some companies may not be aware they are listed as a defendant.
Mr. Spitzzeri is the co-chair of Johnson & Bell’s Employment group. He has litigated race, sex and national origin cases under Title VII as well as age and disability cases under ADEA & ADA. He has also litigated cases under the Illinois Human Rights Act as well as other wrongful termination litigation and litigation arising from breach of employment agreements’ restrictive covenants. Mr. Spitzzeri has handled administrative matters before the EEOC and the IDHR. He has also litigated FLSA and FMLA cases as well as actions brought under the Illinois Wage Payment and Collection Act and Illinois Minimum Wage Law.
The Labor and Employment conference will take place on June 12 – 14, in Bluffton, South Carolina. The other panelists include Dean Robertson, from Vitas Healthcare, Kim Metrick, from Walgreen Co., and the moderator, Joel O’Malley, from Nilan Johnson & Lewis.
