Unique trial techniques and courtroom trends are always emerging, and litigators should be aware of their constant evolution. Being up to date allows attorneys to plan effectively by acknowledging these new techniques before they arise. Johnson & Bell’s Julie J. Busch, along with fellow ALFA International colleagues, J. Philip Davidson, and Jonathan Lieb, evaluate some of these trends in a new article.  The article’s purpose is to help counsel with the planning process by offering an update on several unique and emerging trial techniques and courtroom trends, including plaintiff’s counsel waiving medical expense claims and other tactics used during motions in limine to exclude evidence related to “paid medical,” plaintiffs attempts at burden shifting tactics during voir dire and other tricks.
